Terms of Service
Last updated October 25, 2026
DRAFT — have a lawyer review before launch.
These terms are between you (the business or agency that installs OptProof) and Gold Standard Web LLC (“we”). By installing or using OptProof you agree to them.
1. What OptProof is
OptProof is software. It is not legal advice, we are not your lawyers, and using it creates no attorney-client relationship. It enforces the settings you choose where your CRM allows an app to act, records what happened, and produces evidence files for your own attorney.
2. Your responsibility
- You alone are responsible for your compliance with the TCPA, state laws, carrier rules and any other law, and for how you configure and use the settings.
- You decide whether each message is marketing or informational, whether a consent record is sufficient, and how to act on opt-outs.
- You keep the Rule Check step in the workflows where you rely on it. If it is removed, the CRM skips it and sends anyway.
- You keep premium workflow actions turned on and paid in your CRM; the CRM bills each Rule Check run.
3. What it can and can't do
The table at what it can and can't do is part of these terms. In short: OptProof cannot stop a text typed by a person, any phone call, or a workflow text without a Rule Check before it is sent; it can only log and flag those.
4. Third-party data
Do-not-call, litigator and reassigned-number results come from the scrubber you connect. We make no warranty that third-party lists are complete, accurate or current.
5. Acceptable use
- No use to evade carrier or legal rules, or to hide sends.
- No purchased-list blasting.
6. Billing
Your CRM's app marketplace bills you. When a subscription lapses or the app is removed, enforcement stops; your evidence stays viewable and exportable for the retention period.
7. No warranty
OptProof is provided “as is”, without warranties of any kind, including fitness for a particular purpose and any warranty that it will prevent a claim or lawsuit.
8. Limitation of liability
To the extent the law allows, our total liability for any claim about OptProof is limited to the fees you paid us for it in the 12 months before the claim. We are not liable for indirect, incidental or consequential damages, or for statutory damages or settlements arising from messages or calls you or your systems sent.
9. Governing law
Wisconsin law governs these terms. Disputes go to the state or federal courts for Kenosha County, Wisconsin.
